1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of Spendly – Budget & Expense Tracker ("Spendly", "the App"), developed and operated by SmartPensil ("we", "our", or "us").

By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the App.

      Age Requirement: You must be at least 18 years old to use Spendly. By using the App,
      you represent and warrant that you meet this requirement.
    

2. License to Use

SmartPensil grants you a limited, non-exclusive, non-transferable, revocable license to install and use Spendly on your personal Android device solely for your own personal, non-commercial purposes.

You may not:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble any part of the App
Sell, sublicense, or redistribute the App or any part of it
Use the App for any unlawful or unauthorized purpose
Attempt to gain unauthorized access to any part of the App or its backend systems

3. Your Account

3.1 Registration

To access Spendly's features, you must create an account using a valid email address and password, or sign in via Google or Facebook. You are responsible for providing accurate and complete information.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at madushanka.lasi@gmail.com if you suspect any unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time via Settings → Delete Account within the App. We reserve the right to suspend or terminate your account if you violate these Terms.

4. Financial Data & Disclaimer

      Important: Spendly is a personal budgeting tool only. It does not provide financial,
      investment, tax, or legal advice. All financial decisions you make based on data in the App are
      your sole responsibility.
    

All financial data (transactions, budgets, goals, planned payments) is entered manually by you. We do not connect to any bank accounts or financial institutions, and we do not verify the accuracy of any data you enter.

You are responsible for the accuracy of your financial data. We are not liable for any financial decisions made based on data stored or displayed in the App.

5. Acceptable Use

When using Spendly, you agree not to:

Use the App in any way that violates applicable local, national, or international laws or regulations
Transmit any unsolicited or unauthorized advertising or promotional material
Attempt to interfere with the proper functioning of the App or its servers
Use automated tools or scripts to access the App
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Upload or transmit any malicious code, viruses, or harmful data

6. Advertising

Spendly is free to use and is supported by advertisements served by Google AdMob. Ads may be personalized based on your interests and device identifiers as described in our Privacy Policy.

You acknowledge that ads are an integral part of the App and agree not to use ad-blocking tools that interfere with ad delivery.

7. Intellectual Property

All content, features, and functionality of Spendly — including but not limited to the App's design, graphics, text, logos, and code — are owned by SmartPensil and are protected by applicable intellectual property laws.

Your financial data belongs to you. By storing data in the App, you grant SmartPensil a limited license to process and store that data solely for the purpose of providing the App's services to you.

8. Third-Party Services

Spendly uses third-party services including Google Firebase, Google AdMob, and Meta (Facebook) Login. Your use of these services is subject to their respective terms and privacy policies:

We are not responsible for the content, policies, or practices of any third-party services.

9. Disclaimers & Limitation of Liability

9.1 No Warranty

Spendly is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

9.2 Limitation of Liability

To the fullest extent permitted by applicable law, SmartPensil shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App — including but not limited to loss of data or financial loss.

9.3 Data Loss

We recommend you regularly review your data within the App. We are not responsible for any loss of data resulting from technical failures, account deletion, or other causes outside our reasonable control.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically. For significant changes, we will make reasonable efforts to notify you through the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation between you and SmartPensil.
